Terms of Service

These Terms of Service ("Terms") govern your use of https://envirogeek.com and services offered by EnviroGeek LLC ("EnviroGeek," "we," "us"). By using the site, submitting a form, booking a pickup, or purchasing from our store, you agree to these Terms. If you do not agree, do not use the site or services.
These Terms are provided for clarity about how our services work. They are not a substitute for advice from your own attorney.
1. Our services
EnviroGeek may provide:
- Free residential electronics pickup for items on our accepted list in the Twin Cities metro (subject to scheduling and service-area limits)
- Business electronics pickup and cleanouts
- Data wiping of computers and phones we collect
- Sales of used / refurbished electronics through our store
We may refuse items that are unsafe, not on our accepted list, or outside our service capacity. Accepted-item lists and service areas on the site may change.
2. Free pickup — pricing
For residential pickups, items on our published accepted list are collected with no recycling fee. Online booking is a request to schedule service — it is not a confirmed appointment until we confirm it (by email, text, or phone).
Business jobs may still be free for accepted electronics, but large or special jobs may require planning details we confirm in writing before pickup. We will not invent surprise recycling fees for accepted residential list items.
3. Your responsibilities
- Provide accurate contact, address, and access information
- Back up any files you still need before pickup — wiping is irreversible
- Remove account locks (Apple ID, Find My, Google, etc.) when you can
- Only tender items that are safe to handle (no biohazards, chemicals, or pressurized cylinders)
- Be available or provide clear access during the scheduled window
4. Data wiping
We wipe computers and phones we collect so personal files and logins are not left on devices that are refurbished or recycled. Business customers who need documentation should request it when asking for a quote; we will confirm what we can provide for that job. You are responsible for removing data you are legally required to retain or control before pickup when your situation requires it.
5. Store purchases (used & refurbished)
- Products are sold as used / refurbished with the condition grade and warranty stated on the product page.
- The website is a catalog only — there is no online checkout or card payment on this site. Prices shown are asking prices; call or message us to confirm and arrange purchase.
- Availability is confirmed when you contact us. An item may sell before your message is answered.
- Unless we agree otherwise, title passes when payment is received and the item is picked up or delivered.
- Warranty coverage is limited to what is stated on the product page. If you have a warranty issue, contact hello@envirogeek.com promptly with your purchase details.
6. Website use
You may not misuse the site (including attempting to break security, scrape in a way that harms the service, submit spam, or impersonate others). Site content is owned by EnviroGeek or its licensors and may not be copied for commercial use without permission.
7. Disclaimers
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY MINNESOTA LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted website availability or that every booking request can be scheduled on your preferred day.
8. Limitation of liability
To the fullest extent permitted by Minnesota law, EnviroGeek is not liable for indirect, incidental, special, consequential, or punitive damages arising from site use or services. Our total liability for a claim related to a paid product or paid service is limited to the amount you paid for that specific product or service. For free pickup services, our total liability for a related claim is limited to $100, except where Minnesota law does not allow that limit.
Nothing in these Terms limits liability that cannot be limited under applicable law (including certain consumer rights under Minnesota law).
9. Indemnity
You agree to indemnify and hold EnviroGeek harmless from claims arising out of your misuse of the site, inaccurate booking information, unsafe items you tender, or your violation of these Terms, to the extent permitted by law.
10. Governing law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Courts located in Minnesota will have exclusive jurisdiction, except where consumer protection laws give you the right to bring a claim elsewhere.
11. Changes
We may update these Terms by posting a new version on this page with a new "Last updated" date. Continued use of the site or services after changes means you accept the updated Terms.
